The final assignment is due 24 hours before the start of last class session. Five points will be deducted for each day the assignment is late.

Specific instructions about the length of answers to each question is provided on the exam; however, it is more important that instead of focusing on length, you focus on providing a thorough answer that addresses each part of each question. The evaluation of your essay will be based on whether you addressed all aspects of the question, the appropriate use of the concepts you have chosen, along with integration of appropriate course materials and support for your arguments.

If References are used, use the following examples of APA format for articles and books in References section:

CASE 1: John sold a pair of skis to Bob, making no specific warranties or promises of any kind other than letting Bob examine and try them. In fact, John did not own the skis; he had only rented them. When the true owner claimed them, Bob demanded his money back. John defended his actions by stating that he had made no warranty of any kind.

Did John give an implied warranty of title? Assess. (5 marks)

CASE 2: In 1967 the plaintiffs, Ashmore, Benson, Pease & Co, manufactured tube tanks. The defendants, AV Dawson, a haulage company, agreed to carry the plaintiff’s equipment by lorry. With the knowledge of the plaintiff’s transport manager, the defendants loaded their vehicle in excess of the weight permitted by the Road Traffic Act 1960, s.64 (2). The vehicle toppled over during the journey, and the plaintiffs sued in negligence for £2,225 in damage caused to the equipment by the defendant’s driving. At first instance the trial judge found in favour of the plaintiffs and awarded damages. The defendants appealed.

Analyze in details the type of contract that took place between the two parties? (5 marks)

Evaluate whether any recovery of damage can take place if a party enters into a lawful contract but the contract is carried out unlawfully. (5 marks)

CASE 3: Employed F to clean a roof which was made of corrugated sheets. F did not take any safety precautions when cleaning. The premises were contaminated with asbestos and needed extensive work to repair the damage. B brought an action in damages for the cost of the repair work on the basis of F breaching contractual terms. F argued that B had contributed to the negligence as B had not supervised F during the cleaning. B counter-argued that their claim was brought under contract law.

Analyze in details the type of breach of duty has taken place? (5 marks)

CASE 4: Leander owns a greenhouse in which she grows flowers and plants for florists. Oct 25th Jason, a retail florists, agrees to buy from Leander 1000 roses. Each plant to cost 1 BD and to be available from December 10 to December 20. Jason paid some advance and requests delivery on Dec 11th. At that time Leander advises him that she will not perform the contract since she can get rose plants for 1.5 BD. Jason refuses to pay more than 1 BD on a plant and continues to insist on deliveryas he has paid advance. On December 16th, an extreme cold spell arrive, Leander‘s heating system breaks down and all the roses she has on hand freeze. Jason then purchases 1000 roses from another wholesale florist but has to pay 1.3 BD a plant.

Has Jason any remedy? Discuss the arguments in his favour. (5 marks)

Introduction

Growth strategies refer to the organizational plan of overcoming the present and future problems in order to achieve its expansion purpose. Businesses undergo a growth strategy to increase their revenue and market share, raise the volume of goods and services produced, and acquire more assets. Many small and large-scale firms usually have plans to expand their businesses to increase profits and sales. However, these firms must use specific methods to implement these growth approaches. The methods that businesses use to grow their businesses depend much on the business’s financial position (Chintalapati, 2020). Firms use different growth strategies when expanding their businesses; for instance, a business may apply strategies like market penetration, acquisition and diversification, product expansion, and market expansion if they plan to grow or expand.

In reference to the question, Seamstress, a brick-and-mortar business, wants to grow its business to e-business. It is crucial for the business to transform to e-business as there are various benefits the business will accrue from that transformation. For example, in the time of uncertainty like the current Covid-19, many shoppers have avoided overcrowding. Measures that have been put in place, such as stay-at-home, have made this business experience turbulent times where their sales have significantly declined. With such a challenge, the only option for the business is to transform and expand to an online business. Expanding brick-and-mortar businesses through the internet will help them to have a competitive edge over others. Where businesses are transacted online, the number of customers or shoppers increases dramatically. Many customers prefer acquiring goods via online platforms; therefore, when Seamstress expands its business to the internet, it will attract online shoppers, hence remaining competitive in the long run.

Additionally, as the business expands to the internet, it will reach more shoppers and groups globally; therefore, for Seamstress to ensure their brick and mortar business grows through online means, they should create e-commerce websites where customers can access it their products. The business will also benefit from nations that are e-commerce active. The use of telesales will also enable Seamstress to reach out to large shoppers who need their product. Using google ad words will also be vital in ensuring that Seamstress attracts more customers abroad. Google ad words is an online advertisement or promotion where businesses market their products to reach their targeted customers, whether locally or internationally. With the use of keywords in the ad, many shoppers will click to search for products they require (McKeown, Niall, & Mark, 2016). Using Google ad words will help brick-and-mortar businesses expand as customers can search for products offered and their costs.

Further, expanding or growing brick-and-mortar business online will help Seamstress meet buyer’s expectations. Customers may require products anytime, and therefore, it may be hard for the Seamstress merchants to meet such expectations. As such, ensuring the business is expanded to the online platform allows the customer to access products and services 24/7 and at their convenience. In addition, since customers are always impatient for answers, it is important to ensure the business sets a time to handle and address customers’ questions and concerns, such as setting 24/7 customer lines, emails, facebook, and chatbots to contact and interact with the business shoppers. Connecting with customers online helps businesses to earn trust and appreciation.

Expanding the business via online platforms such as the internet will enable Seamstress to minimize cost. The overall goal of a business is to make a profit. It can be challenging to achieve that if the overhead costs such as acquiring store, office suppliers, salaries, and rents are higher. Hence, when the brick-and-mortar business is online, many of the overhead costs will be eliminated. Also, growing this business to the internet will help Seamstress lower expenses related to marketing and other staffing expenses. Online marketing is cheaper when compared to traditional methods (Chaffey, & Smith, 2017). Embracing digital marketing like user-generated content and blog post can assist Seamstress to expand its brick-and-mortar business effectively and efficiently.

Finally, growing their business through advocacy will also be crucial in ensuring the brick and mortar industry expands. With ad words, Seamstress can understand the number of customers who have searched their product and their intent to know if they wanted their products. Although searching products online does not mean demand for the products, Seamstress should identify why shoppers searched their products.

In conclusion, local businesses that want to make huge profits, increase sales volume, and have a significant market share should expand their businesses. In the case of Seamstress, expanding its brick-and-mortar business through the internet or e-commerce will help it benefit from the move. For example, the business will make huge sales as customers will access their products more conveniently through the Google search engine. Also, they will have the edge over their competitors, have a significant market share, and will be able to attract and meet customer’s expectations. Therefore, I will advise Seamstress to transform their business to the internet since they will enjoy a wide range of benefits.
